Continued obligation to notify for grocery chains

The Norwegian Competition Authority has informed the grocery chain groups that the Authority will prolong their obligation to notify their agreements with market-dominating suppliers. The obligation to notify implies that Norgesgruppen, Coop, Rema 1000 and Ica must send their agreements with 19 market-dominating suppliers to the Norwegian Competition Authority.

In order to be able to effectively monitor the state of competition in the groceries market, the Authority wishes to prolong the four grocery chain groups’ obligation to notify. The notification obligation that is in force today was introduced in 2005 with a duration until January 2010. The new notification obligation applies until 2015.

The regulation grants the Authority the possibility to investigate the agreements and assess any anticompetitive effects. The notification obligation does not imply that the Authority approves the agreements. The suppliers and grocery chain groups have the responsibility to ensure that the agreements are not in violation of any law.
